MBTA Appeals Dec. 19th Judgement

court-gavelDear members,

In a continuing effort to keep you updated on the court proceedings surrounding our arbitration award, we wanted to inform you that the MBTA has appealed the judgement made by Superior Court Judge Janet Sanders on Dec. 19th. Click here for a copy of the notice of appeal.

Our attorneys advise us and the union that the appeal has little chance, and that our award and contract remain in effect. We will continue to keep you updated as new information becomes available. If you have any questions, please contact the union office.

In solidarity,

Executive Board,
Boston Carmen’s Union, Local 589

I have read most of the replies to this matter we face.
    We should not stage any
actions that are in violation of Laws and regulations we agreeded to. That would play right into their hands. I know the words be professional and patient might be a hard pill to swallow. Sometimes sitting back and let the hand play out is the best strategy. If anything thing, this show the public that 589 members are skilled professionals.
That give are all to provide the best
possible service to them. Even when we are being treated badly.
They are running out of appeals Now.

Stay safe and warm out there….

Observe all of the safety rules, laws, and regulations. Call in every thing. Work safely and write to all of your political representatives. Tell them that the Governor and MBTA management are anti labor as they do not honor lawful arbitration awards. Together we can make our voices heard.

    • TANKBOY on January 2, 2014 at 5:43 am

since i’m a 589 member i want an emergancy meeting to be called to dissxcuss this with 589 lawyers and delegates this wot you people get paid for to repersent us .

    • TANKBOY on January 2, 2014 at 5:34 am

All 589 has to do is……. Contact the people they endorsed for election ,, SEN. Warren SEN Markey Secetary John Kerry, and all the rest thruout the state to call on the GOV to pay us wots Due. Come on guys why hasent this happen???? I remember back in early 1990 the United food and commercials workers union, (Stop &shop people) was having dificulty they step in and called on Sen Kerry! guess what ! they had a contract signed in 1 day, hint hint 589 delegates , Time to call on the Big Guns NOW!

    • mikdig on January 1, 2014 at 5:12 pm

It is time for our union leadership to lead not just collect a check and golf and go to delegations and get drunk. stop telling us what they are doing. Tell us what we are doing. We have played fair and square every step of the way and it hasn”t gotten us anywhere. What next.???

    • j cat on January 1, 2014 at 3:42 pm

1982 was not a strike job action , that was a gov KING MBTA lock out .that was a violation of the contract.

    • TANKBOY on January 1, 2014 at 1:55 pm

they had a 1 day bang in in1982 i belive i think it took a year to give everyone a 1 day suspension for doing it. just go by the book have a work slowdown by calling in everything.

    • T-bag on January 1, 2014 at 1:33 pm

We need to do something. The way they treat us is bad enough, but now they are just being vindictive. We all know the stories of how they have treated people and now they are just treating us ALL like crap.

What do they have to gain by this? Nothing but hurt us.

What the hell, 589? Grow some balls and call to action. Time to make our disgust known!

    • Mad Scientist on January 1, 2014 at 12:45 pm

Extreme slow down or a one day bang in will send the message. This company could careless about its employees.

    • Jopa on January 1, 2014 at 10:42 am

Once again Davey and management stick it to the hardest workers at the T bus drivers and subway operators. Them saying we are appreciated is a crock of shit and they continue to look down at at us as scum. We are the ones who bust our asses everyday and are put in harms way dealing with all the bullshit from passengers and are never right. We are the ones that are always disciplined for petty shit that’s why I will never go out of my way to throw someone off the bus for being short on fare. Wake up people it is management that we should be against and not the public. Enough with the bullshit it is time to stand up and show them they are not better than us.

    • misled on January 1, 2014 at 9:47 am

    They won’t defeat us….

    • misled on January 1, 2014 at 9:45 am

Stand or fall?? Nows the time to Stand together. If we show them we’re Strong by sticking together they won defeat us…Go by the book follow their bs rules call everything in and don’t take shortcuts to make things go smoothly for these hacks …. and they want more for less…well union members take action show those unappreciative so called management bleeps we don’t settle for less…put them in their place rally at statehouse 1 day bang in by all stop service….its all or none people

    • TANKBOY on January 1, 2014 at 8:24 am

i must say with over 27 years at the mbta i never got paid on thursday even tho thursday is a reg pay day , for them the mbta paying us on tuesday on thanksgiving and xmas and not new years eve is a message saying fuck you employees and you’ll have to wait another 3 months for any raise and retro. They are trying to delay all the way up to end on this contract in june 2014 this gives them the reason to argue on a nego new contracts with us, changes the ball game dramaticly. GIC is just another scare tactic, they will make us wait for our award like we made them wait for 4 years puting us into it gic, cuz they broke the rules and tryed to sneak it in , i think mystery bus tours should be brought back like we did to BIG RED! No to Daveys House Patricks house even that GM of wot the MBTA? i havent seen or heard of her in the last 4 months LOL

    • Dave on December 31, 2013 at 11:26 pm

    • Dave on December 31, 2013 at 11:21 pm

    • chris on December 31, 2013 at 10:44 pm

I believe its time to take a stand. We should follow the letter of the law in regards to operating any T vehicle, which clearly states no more than 10mph over bridges and etc. Our union reps need to show our delagation why we elected them in office for. We (local 589) have been patient through this process and only are being disrespected and under valued by the commonwealth of Massachusetts. I bet if we were all sick for a day, they would learn to have a better appreciation for us. “Stand for something, or fall for anything!!!!!!”. Sad to say but it seems like our elected reps are fallen for everthing!!!!!!!!!!!!!!!!!!

    • Jason Scales on December 31, 2013 at 9:48 pm

Honestly, this is a sham. I understand that the Authority is well within their rights to appeal but it really is a punch in the face to us workers. I know the lawyers say it’s a slam dunk for us, but come on! Dragging it out like this only drags morale that much lower. I know it’s more money into the retro but it’s also more loathing that I feel towards the powers that be. We really need to send a message that “ENOUGH IS ENOUGH!”

    • TANKBOY on December 31, 2013 at 9:37 pm

Mystery Bus tour to Pattys house and to scotts house and daveys house, picket the sob’s

    • j cat on December 31, 2013 at 7:45 pm

I knew the governor would not wait very long. since he is doing this to bust the union. Now is the time to picket the state house and his house. follow him at events. make him look like the azz he is..

The union should counter sue for damages as this is a sham. the state should pay all legal costs and the back wages should have interest charges applied.

    • Fedup on December 31, 2013 at 6:56 pm

Once again management has showed what they really think about us as workers. THEY KEEP CHANGING RULES AND DON’T TELL US. Now instead of a Christmas bonus and they don’t deposit our checks early so we can have a nice New Years Eve and Day they wait till the last minute and say FUCK YOU very much.

    • rules on December 31, 2013 at 6:55 pm

How about we just play my the rules and beat them at it. They don’t play by their own rules anyway

    • Pis$ed on December 31, 2013 at 6:25 pm

Enough is enough. 589 grow a set! Sick outs, protests at the State House and stations, slowdowns are all in order. If they want to show us no respect its about time we show that clueless moron of a GM, the Gov and the Transportation Secretary even less respect. Go to the media and make them look foolish!

    • Duke on December 31, 2013 at 6:06 pm
